Terms of Use

This English text is provided for convenience. In case of any discrepancy, the Japanese version prevails.

These Terms of Use (the “Terms”) set out the conditions for using “Koura Diary” (the “App”). By using the App, the user is deemed to have agreed to these Terms.

Article 1 (Application)

These Terms apply to all relationships between the user and the developer concerning use of the App.

Article 2 (Use)

1. The App is intended to assist with keeping care records for tortoises.
2. The user uses the App at their own responsibility.

Article 3 (Accounts)

1. You can start using the App with an anonymous account. To carry over data or share with family, you can link an Apple or Google account.
2. The user is responsible for managing their own account.

Article 4 (Sharing within a Family / Household)

1. The user can create a “household” and share records with other users such as family members.
2. When you share a household, the records, photos, and animal profiles of that household can be viewed and edited by members of the same household. Choose whom to share with at your own discretion and responsibility.

Article 5 (Support Feature / Payments)

1. The App may include an optional payment (tip) feature to support development.
2. Payments are made through your app store, and refunds and the like follow the store’s policies.

Article 6 (Posting Features “Everyone’s Turtles” and “Today’s Turtle”)

1. The App includes a board (“Everyone’s Turtles”) where turtle photos and information (name, species, and time since adoption) are published to other users within the App.
2. “Everyone’s Turtles” shows photos chosen by the developer from “Today’s Turtle” posts (paragraph 8) whose posters allowed them to be kept on the board. The developer decides which photos to choose, and posters are not notified when their photo is chosen. Posts submitted directly to “Everyone’s Turtles” from earlier versions of the App are handled as follows: first-time posts and other posts the developer decides to check are published after the developer’s approval, and posts from users with an established posting history are published immediately and reviewed afterward. The developer may decide whether to publish, and may unpublish posted content, without disclosing reasons.
3. Users may post only photos they hold the rights to. By posting, the user grants the developer a royalty-free license to store, display, and distribute the posted content to the extent necessary for display in the App. Copyright in posted content remains with the user.
4. Posting content that infringes the rights of others, content unrelated to turtles, or other content the developer deems inappropriate is prohibited. The developer has zero tolerance for objectionable content and abusive users. Where the developer judges content or conduct to fall under this clause, posts may be unpublished and the posting feature or the account itself may be suspended, without prior notice.
5. Users may withdraw (delete) their own posts at any time. Photos kept on “Everyone’s Turtles” can also be withdrawn from the board screen.
6. Inappropriate posts can be reported to the developer via the in-app report feature. The developer reviews reports and takes action such as unpublishing where necessary.
7. Users can hide a particular poster’s posts from their own screen (blocking). Blocking is not notified to the other party, and users can undo it themselves.
8. The App also includes “Today’s Turtle”, a feature that lets users publish a turtle photo and information (name, species, and time since adoption) to other users for 24 hours only, at most once per day. Only photos that pass automatic screening (detection of inappropriate images and human faces) are published, and each post is hidden automatically after 24 hours. Photos in “Today’s Turtle” are published based on the result of automatic screening, without prior approval by the developer. Automatic screening does not guarantee accuracy, and paragraph 4 and Article 7 apply to posts that pass it. Photos in which a human face is detected are not published (small faces and the like may not be detected). Paragraphs 3 through 7 also apply to “Today’s Turtle”, and the developer may unpublish posts without disclosing reasons. If you turn on “Keep this photo on the Turtle Board” when posting (it is off by default), the developer may choose the photo, publish it on “Everyone’s Turtles”, and keep it on the board after the 24 hours. A photo kept on the board stays published until you withdraw it, delete your account, or the developer unpublishes it.
9. If a “Today’s Turtle” post is reported, it is hidden immediately and the developer reviews it afterward. The developer may also suspend a user’s ability to post to “Today’s Turtle” without prior notice where the user is judged to be acting inappropriately. After a post is hidden, withdrawn, or expires, the photo file may remain on the server for up to a few days.
10. When posting to “Today’s Turtle”, or afterwards, you may add an optional caption (up to 40 characters, no line breaks).
11. Your first caption is not shown to other users until the developer has reviewed and approved it. A caption that is not approved is not shown and only the photo is shown (photos are shown once they pass automatic screening, as before).
12. If you have a caption the developer approved before, and none of your captions was declined and none of your posts was reported, your caption may be shown without waiting for review. The developer still reviews it after it is shown and removes it if it is inappropriate. Once a caption is removed, your captions are again shown only after review. In all other cases, a caption is not shown until the developer has reviewed and approved it.
13. Captions must not contain personal information, content that defames others, or content that violates law or public order and morals.
14. Like the photo, a caption stops being shown 24 hours after posting. However, when a photo is kept on “Everyone’s Turtles” under paragraph 8, the caption that was shown with it (including its translations) is kept with it. Withdrawing a post or deleting your account also deletes the caption.
15. A caption that is shown (including one shown without waiting for review) may be machine-translated for users of other languages and shown together with the translation.

Article 7 (Prohibited Conduct)

In using the App, the user must not engage in conduct that violates laws or public order and morals, that interferes with the operation of the App, that infringes the rights of other users, or that the developer otherwise deems inappropriate.

Article 8 (Disclaimer)

1. Health and nutrition information shown by the App is a general guide only and is not veterinary care, medical care, or professional nutritional advice. See the Disclaimer for details.
2. The App does not warrant the completeness, accuracy, or usefulness of the storage, display, or synchronization of records. Data may fail to be reflected due to network conditions or service circumstances.
3. The developer bears no liability for any damages incurred by the user as a result of using the App.

Article 9 (Data)

Records and photos entered by the user are stored for the user themselves and for the households they share with. Handling of data follows the Privacy Policy.

Article 10 (Intellectual Property)

Intellectual property rights in the App and its content belong to the developer or the rightful rights holders (excluding content posted under Article 6).

Article 11 (Changes to the Terms)

The developer may change these Terms without notice to users where deemed necessary. The revised Terms take effect once posted on this page.

Article 12 (Governing Law)

These Terms are interpreted under the laws of Japan.
